What Debt Credit Counseling Bankruptcy Sessions Are Required

If you are considering bankruptcy, then you first need to do whatever you can to avoid this. Many people simply feel this is an easier step than actually trying to work out a payment plan, but the fact is it is not. However, if you have exhausted every possible avenue then you might need to consider bankruptcy as a last possible resort. However, you need to know that a Debt Credit Counseling Bankruptcy session is required by law in order to proceed with your bankruptcy case.

A Debt Credit Counseling Bankruptcy session will have to be done pre-filing as well as post-filing. These counseling sessions will have to be conducted by an accredited consumer counseling service. A Debt Credit Counseling Bankruptcy session will be offered for free if it is deemed that you can't afford it. If it is determined that you can afford it the pre-filing cost is around $50.00.

Once you have completed the pre-filing session, you will then receive a certificate which must be presented to the courts in order for your bankruptcy case to continue forward. Unless you provide a certificate from a certified and accredited service, your case will be on hold.

After the bankruptcy proceedings are over, you will be required to complete a post-bankruptcy Debt Credit Counseling Bankruptcy session as well. These particular sessions are also provided for free if you can't afford one.

This session can be a little more intense in that all the areas of financial responsibility are covered. The counselor will recommend that you work on creating a firm but workable budget. They will try and impress upon you the mistakes that led you to bankruptcy and how to avoid making the same mistakes in the future. These meetings tend to last around 2 hours and are required to official discharge your bankruptcy case from the courts.

However, in some instances, the court will discharge your case before you have has a chance to participate in your post bankruptcy counseling session. In theses cases, you will not be required to take the counseling session.

The fact is that the reason why these Debt Credit Counseling Bankruptcy sessions are required is because people in the past and even today are abusing the bankruptcy laws in order to not pay back debts when they could indeed work out a plan. By requiring the people to have the opportunity to become better educated on finances and the proper way to deal with them, it is thought that this would make people less likely to try a bankruptcy in the future.
